Builders Agreement

Client will be responsible for, and shall verify, all information on the floorplans prior to construction of project. Client shall notify Builders Plan Mart of any variations of information shown on the house plans before permits are issued. Builders Plan Mart shall be entitled to rely on the accuracy and completeness of information furnished by the Client. Client shall provide prompt notice to Builders Plan Mart of any errors, omissions or inconsistencies in such information provided.

• Builders Plan Mart retains title, ownership and all common law and statutory copyright and intellectual property rights in all its designs provided and/or prepared for their clients.
• The Client agrees that, to the fullest extent permitted by law, Builders Plan Marts total liability to the Client for any and all injuries, claims, losses, expenses, damages or claim expenses arising from any cause or causes shall not exceed Builders Plan Marts fees for the blueprints. Such causes include, but are not limited to, Builders Plan Mart negligence, errors, omissions, strict liability, breach of contract, or breach of warranty.

In recognition of the risks, rewards, and benefits of the work performed by Builders Plan Mart, the Purchaser agrees that, to the fullest extent permitted by Law, Builders Plan Marts total liability to Purchaser for any and all injuries, claims, losses, expenses, damages, or claims arising out of this License Agreement, from any cause or causes of action, shall NOT exceed Builders Plan Marts total fees for this Builders Plan. Such claims include, but are not limited to, Builders Plan Marts alleged negligence, errors, omissions, strict liability, breach of contract, or breach of warranty.
